Tax treatment for Mexican investors
Mexican residents without commercial activity are exempt from income tax on the sale of CBFI related to Fibra to the extent that the corresponding sale is made through the Mexican Stock Exchange or a recognized market.
Tax treatment for foreign investors
For distributions, non-Mexican CBFI holders are generally subject to withholding taxes in Mexico at the corresponding corporate tax rate. Withholdings are subject to reduction or exemption for certain classes of investors (ie, pension funds).
With respect to the sale of FIBRA CBFIs, non-Mexican holders are not subject to income or withholding tax in Mexico, provided that such sales are made through the stock exchange or a recognized market.
